In Alabama theft is defined as, Knowingly, obtaining unauthorized control over the property of another with intent to deprive the owner of their property. The value of property that is involved in the theft or the circumstance is a determining factor when classifying a charge. In Alabama there is third degree theft, second degree theft and first degree theft. Consequences

In Alabama the classifications for theft are first, second and third degree theft. Each classification is dependent on the value of the property involved, and the higher the value of the property means more consequences for the charge.

Third Degree Theft – Theft is classified as third degree when the value of the property involved is less than $500. Third degree theft is the lowest theft charge a person can receive in the state of Alabama. Third degree classification is considered a class A misdemeanor. The fines for third degree theft could be up to $6,000 and jail time up to one year.

Second Degree Theft – Theft is classified as second degree when the value of the property involved is greater than $500 but not greater than the amount of $2,500. The dollar amount is not the sole determinate of what is considered second degree theft. Certain types of property that is stolen, such as, credit or debit cards, controlled substances, and firearms are automatically considered second degree theft in the state of Alabama. Second degree classification is considered a class C felony. The fines for second degree theft could be up to $15,000 and jail time up to 10 years.

First Degree Theft- Theft is classified as first degree when the value of property is greater $2,500. Theft of any property taken directly from the person of another and theft of a motor vehicle is considered first degree theft in the state of Alabama. First degree theft is the most severe theft charge. The classification for first degree is a class B felony. The fines for first degree theft could be up to $30,000 and jail time up to a maximum of 20 years.
